I noticed that too. I think Harry was practicing magic and that was okay. That's why he didn't got in trouble. Hermione's spell in Diagon Alley was okay too. Besides, the magic was not in front of Muggles. Hermione always follows rules.

That's sort of what I was thinking, too. If it isn't in front of Muggles, all should be fine.

I think they didn't sentence him for that firstly because he was Harry Potter, chased by the murderer Sirius Black and everyone was worried about him and secondly because he was all alone, no muggles present in the room... So it was kind of okay to do magic.
But still... a mistake from the moviemakers.

This bugged me so bad because then later in the same film Fudge helps him out with Marge yet doesn't mention the previous incident. WTF?

Well the movies had always sot of... went their own way. They have never exactly fallowed the books completely, and in the book it states he is using a flashlight. It is a simple error and to those who had never read the book, it probably won't register to them anyways.

It most likely wasn't even an error. The amount of work that went into making these films it couldn't have been an error, because it's used in other films too.

Just realised the lumos mistake for the first time in my life. Don't know how it failed to occur to me all these years! Sigh!
