Yeah, you get in trouble for attempted homicide, too. I don't know why the botched attempt gets you a lighter sentance, but it does.

I don’t think the killing curse would be enough to kill Voldemort. Otherwise someone would've done it ages ago and even tho they would've been sent to Azkhaban, they'd be dubbed a hero and probably set free in the end. Harry is going to have to use something else to defeat VM, something much more meaningful to VM… the horcruxes will definitely have a factor in this…

I doubt many people actually get a chance to throw a killing curse at Voldemort. And the whole prophecy thing. Dunno.

After the horcruxes are distroyed the killing curse will then work on The Dark Lord like anyone else.
